WARRANTY
This Warranty Agreement is entered into between A1MS Fashion LLP (referred to as "Company"), operating under the brand name "unityofhandloom," and the customer. This Agreement outlines the terms and conditions regarding the warranty provided for sarees purchased from unityofhandloom.
1. Warranty Coverage:
a. The Company provides a warranty on sarees purchased from unityofhandloom against manufacturing defects for a period of 90 days from the date of purchase.
b. The warranty covers defects in materials and workmanship under normal use and care.
c. This warranty is applicable only to sarees sold directly by unityofhandloom and is non-transferable.
2. Warranty Claims:
a. In the event of a defect covered under warranty, the Customer must notify the Company within the warranty period by contacting the customer support team of unityofhandloom.
b. The Customer may be required to provide proof of purchase, such as the original receipt or order confirmation, along with details of the defect.
c. The Company reserves the right to inspect the saree to verify the defect before processing any warranty claims.
3. Warranty Remedies:
a. Upon validation of a warranty claim, the Company will offer one of the following remedies, at its discretion:
i. Repair: The Company may choose to repair the defective saree, restoring it to its original condition.
ii. Replacement: If the saree cannot be adequately repaired, the Company may replace it with an equivalent saree of the same or similar design and value.
iii. Refund: In cases where neither repair nor replacement is feasible, the Company may offer a refund for the purchase price of the defective saree.
b. The Company's decision on the appropriate remedy shall be final and binding.
4. Warranty Exclusions:
a. This warranty does not cover damage or defects caused by misuse, improper handling, alterations, accidents, negligence, or normal wear and tear.
b. The warranty does not cover damages resulting from failure to follow the care instructions provided with the saree.
c. The warranty does not cover color variations, minor imperfections, or natural characteristics of the fabric that do not affect the functionality or structural integrity of the saree.
d. Any modifications or repairs made by unauthorized parties will void the warranty.
5. Limitation of Liability:
a. The Company's liability under this warranty shall be limited to the repair, replacement, or refund as specified in Section 3.
b. In no event shall the Company be liable for any indirect, consequential, or incidental damages arising out of or in connection with the warranty or use of the saree.
c. The maximum liability of the Company under this warranty shall not exceed the purchase price of the saree.
6. Governing Law and Jurisdiction:
This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in [insert jurisdiction].
